• 'Martialartswords.com' is a registered company in province of Ontario, Canada. The business is also known as 'MAS' and 'Butouken'. On all financial transaction, the company name will appear as 'Martialartswords.com.'

Tariff/Duty

•    Customers are responsible for paying applicable tariff/duties/taxes. US duty rate for a sword is 2.7% in 2007.
  

Pricing

• Prices are subject to change without notice. Merchandise will be invoiced at the price on the date the order was received.
• All pricing in U.S. dollars.
• Dealer pricing is only available to qualified dealers, as determined by Martialartswords.com.

Damaged Shipments

• If shipments shows any sign of visual damage, please make note of the waybill or receiving ticket and have it signed by the driver. If damage to shipment is concealed (not visible from exterior), keep all packing material and the original carton. In both cases, notify us immediately.
• All claims pertaining to damaged or incorrect shipments must be reported within 5 days of receipt of goods.
  

Warranty

• 45 days from the date of invoice: Martialartswords.com will provide repair or replacement (to be determined at our discretion) against manufacturer’s defects in workmanship or material only. Original proof of purchase required.
• Please remember that our pieces are handmade. They are not stamped or poured. As a result, there will be some variances. This is normal.
• Warranty voided if it is determined by Martialartswords.com that merchandise is damaged or worn by abuse of any kind, misuse, lack of reasonable care, disassembly of product, or extended use (i.e.: normal wear and tear). Please remember that all swords are subject to the laws of physics and are destructible. Cutting should be done under proper instruction and supervision and performed on proper materials.

Payment

• Visa, Mastercard or Paypal.
• Money orders and cheques accepted only after business relationship has been established. (Please allow 15 business days to clear).
• No C.O.D. or open accounts.

Payment Authorization

• Payments are subject to off-line checks before being accepted such as pricing errors and mismatched shipping details. Credit card payments are processed through Psi Gate and are subject to their rules and conditions. You must be 100% authorized to make the payment using your credit card. Please be aware that we may require further identity verification for users of free email address services such as hotmail.com. This may delay the processing of your order.

• If your payment is declined it could be for a variety of reasons. For security purposes we will not specify exactly what the problem is. However, any of the following could be wrong:

The credit card number
The cardholder's name does not match the one on the card
The start or expiry date
The security/CV2 code
The issue number
The customer address does not match the cardholder's address
The delivery address does not match the cardholder's address

Discounts and Promotional Prices

• Any discount or promotional price may have its own separate terms and conditions. These will be available on the web site (usually by clicking on a web link relating to the discount or promotional price) or by requesting them from customer services either by email, letter or fax. If you return any discounted or promotional product you will be refunded at the discounted or promotional price.
  

Security

• Martialartswords.com uses industry standard practices and technologies including, but not limited to, Secure Socket Layers, data encryption and firewalls. However, information transferred over the Internet cannot be guaranteed to be completely 100% secure. Therefore, we employ many different security techniques to protect such data from unauthorised access by users inside and outside the company but we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.
• At the time of "checkout" you should check that your web browser has established a "secure connection" to our server. This is usually in the form of a padlock symbol/icon in one of the corners of your web browser window (dependent on the web browser you are using).

Password

• Your personal information is stored within your "account". To access your user account you need your email address and password. You are highly recommended to use a strong password. It should be at least six characters in length and use both upper case and lower case letters along with numbers. You can change your password at any time by logging into your account and visiting the "my details" page.

Fraud

• It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. Psigate tracks the electronic "fingerprints" of every order placed on Martialartswords.com to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website. Any fraudulent activity will be fully investigated in conjunction with the relevant law enforcement departments.

Minors

• The Martialartswords.com website is not intended for minors. If you are under the age of 15 you may only submit personal information to us or browse the site with the supervision of a parent or guardian. Orders will not be accepted from minors (i.e. those people under the age of 18).

Disclaimer

• Client is responsible for determining and complying with any government regulations pertaining to ownership and use of Butouken products.
• Except in the event of gross negligence, Martialartswords.com, its employees, management and associated third parties shall have no liability whatsoever to the client or anyone claiming through the client as a result of any loss, damage or injury suffered as a result of any products purchased hereunder. Further, client does hereby indemnify and hold Martialartswords.com and the above mentioned parties, harmless from and against any and all cost, liability or expense (including legal fees and expenses) in any way associated with items purchased from or through Martialartswords.com.
• Transactions and agreements with Martialartswords.com shall be construed under and according to the laws of the Province of Ontario, without regard to any conflict of laws provisions. Client hereby agrees that any claim arising out of the products purchased hereunder shall be brought in Ontario in the event that Martialartswords.com shall make a claim against the customer.
• In the event of any dispute hereunder, the losing party shall be responsible for and shall pay any and all legal fees and costs incurred by the prevailing or substantially prevailing party, as the case may be.
